Estate Planning

 

The key word that describes Estate Planning is "Trust."  It is knowing what you have, who you have, and where you want everything to go, with the Trust that a survivor will actually perform your wishes under your Last Will and Testament.   Powers of Attorney designate a person you Trust to take care of your business if you cannot handle your financial affairs.  A Living Will is a directive to medical facilities regarding life support.  Probates are the legal procedure by which all possessions are distributed upon death.  I work closely with clients in all facets of this area of law and these decisions of life.
 

Landlord/Tenant

 

Landlords think that tenants have all the protections under the law.  It is easy to be a tenant -- pay your rent, don't destroy the premises, and do not engage in criminal activity on the premises.  Landlords win if a tenant does not perform accordingly.  It takes a bit of time to conform to the judicial timetable but the tenant will be evicted.  Though I do give advice to tenants, my expertise is on the Landlord's side.

Personal Injury


Personal Injuries include traffic accidents, premises liability, slips or trips and falls, and other damages caused by someone's negligence.  You should  always secure an attorney to represent you because the insurance company's attorney represents his client, the insurance company, and may not have your best interests in mind.  This office works with the insurance companies in an effort to meet the needs of all parties involved while at the same time assisting the injured with their medical needs to make the injured as healthy as possible.

Contract Law

 

An offer, an acceptance, and bargained-for consideration (something of value, such as money) must all be present to have a valid and enforeable contract.  Signed contracts with both parties are most enforceable.  Promises are enforceable in Washington State, but one's principal is expensive.  ALL land transactions MUST be in writing and recorded at the courthouse.  All contracts, work changes and cost overruns of contractors must also be in writing and signed by both parties.  I would rather councel a contractor what is correct than get him or her out of trouble later.
 

​ADA

 

Americans with Disabilities Act (ADA) is a federal law which defers to those Americans that need assistance or "accomodation" in the performance of daily events.  There are many layers to ADA including Title 504, which states that if a person has a handicap that interferes with a "Life Event", that person gets all the ADA protections.  "Learning" is a life event and so ADD, ADHD, and social phobic children in schools get ADA protections and accomodations.
 

Torts

 

Torts are civil wrongs.  In criminal law, a defendant is found guilty and is imprisoned.  In tort law, defendants are found liable and pay money damages.  Examples of torts are negligence, defamation, wrongful death, interference with a business transaction, and intentional torts which include battery, assault, false imprisonment and conversion.  The basic law of torts is reasonableness and, if a defendant acts unreasonably that person may be found to be liable for money damages.  These are fact questions and may become jury questions.  Settlement and mediation are always available through my office.
